Terms and Conditions for Group technique and Squad training sessions
The following terms and conditions apply to all participants (“you”) attending adult group swimming lessons organised by Speedy Swimming (“we” or “us”). Please ensure you have read and understand the following and please keep a copy for your records.
1. Acceptance of terms and conditions

By booking onto our squad training sessions you are accepting these terms and conditions and they will form a binding contract between you and us.

You will ensure that you follow the swimming pool rules (Aldershot pool or Guildford Lido - depending on location of the squad) set out at the start of each swim session, and any rules that are specific to Aldershot pool or Guildford Lido.

We reserve the right to vary these booking terms and conditions at any time upon reasonable notice to you.
2. Lessons

All lessons will start promptly at the agreed start time. If you arrive late to the pool, warm up in an adjacent lane or join the back of the lane if they are doing swim drills or intervals.
3. Minimum requirements

In order to attend our courses you must be able to swim 100 metres of a front crawl swimming stroke continuously and without rest.

If in our coaches professional opinion you are unable to comply with these minimum requirements, you will be asked to leave the group lesson and will not be able to take part in further group lessons until you have demonstrated to us that you meet such minimum requirements. You will not receive a refund of your lesson fee. This is just so that we can provide the group with an equal level of coaching throughout the session, and isn't to put you off swimming with our Speedy Swim Clubs.

4. Registration and contacting us

Before attending any lessons with us you must register your details with us either on our website www.speedyswimming.co.uk (hereafter ‘website’), eventbrite registration form, by telephone 07958 635142, or email speedyswimming@gmail.com.

Participants must be over 18 years of age.
5. Payment

Our group lessons are paid via monthly subscription. The fees for group lessons are set out on our site.

We accept the following methods of payment:
advance purchase on our site (by major credit/debit cards) or via paypal.

We do not offer refunds if you are unable to attend a group lesson on a particular week for one of our swim squads.

6. Cancellation

If we need to cancel a group lesson we shall try to give you as much notice as possible of any such cancellation. We shall not be liable for any losses of any kind incurred by you as a result of such cancellation.

7. Illness and medical conditions

If you have an upset stomach, or sickness in your family on the day of the lesson or in the 7 days before the lesson, you must inform us beforehand, ideally with 24 hours notice. We reserve the right not to allow you to attend the lesson for your safety and that of others in the group.

You must declare to us all medical conditions, regardless of severity, and if they change due to unforeseen circumstances during the course, i.e. on a particular week. We will in our absolute discretion decide whether such medical conditions will restrict your engagement in group lessons and we will notify you of our decision within 48 hours of receiving your notice.

It is your responsibility to ensure that you are medically safe to swim. We will not be liable for any accidents or injuries arising from swimming with us that relate to your individual medical conditions, save that nothing in these terms and conditions will limit the liability of any person for death or personal injury caused by negligence. You will need to sign the waiver and disclaimer we email you upon signing up to a course.

8. Safety and general rules

You are responsible for your own safety, actions and behaviour on any part of the swimming pool property including the changing area.

Safety for all is our paramount concern and we have the right to remove anyone on, in or around the pool who gives us any concern whatsoever with regard to safety.

Shoes must be removed before entering the poolside or overshoes worn.

Please obey the lifeguards requests at all times.

10. Limitations of Liability

Whilst every reasonable precaution is taken by us to ensure security and safety at our group lessons, we shall not in any way be liable for any loss or damage arising in any way from our group lessons or the venues we use. However, nothing in these terms and conditions shall limit the liability of any person for death or personal injury caused by negligence.

Any claim against us arising from attendance at one of our group lessons must be notified in writing to us within six months from the day of the relevant lesson and we shall not be liable for any claim that is notified to us after this time.

In any event, we shall not be liable to you:
For any purely economic loss, for consequential or indirect losses or for any loss of profit or opportunity;
(where the claim is insured) for any loss which we are unable to recover from any insurer;
(where the claim arises as a result of something which was done or not done by a third party) for any loss which we are unable to recover from that third party; and
for any loss which is greater than the fee paid by you for the group lesson.

In the event that you cause harm, damage, loss or injury to any other person or property during the course, you agree to indemnify us and reimburse us for all claims, losses, damages, expenses (including reasonable legal fees), and any other liability suffered by us as a result of such harm, damage, loss or injury caused by you.

We shall not be liable for any loss or theft of your personal possessions and all property left by you in changing rooms, the car park or anywhere else on or in the vicinity of our venues is done so at your own risk.

11. Assignment and subcontracting

We may at any time assign, transfer, charge, subcontract or deal in any other manner with all or any of our rights under the contract between us and may subcontract or delegate in any manner any or all of our obligations under the contract between us to any third party or agent.

You shall not, without our prior written consent, assign, transfer, charge, subcontract or deal in any other manner with all or any of your rights or obligations under the contract between us.
12. Governing Law
-
This Agreement and these Conditions shall be governed by and construed in accordance with the law of England and Wales and you agree that any disputes shall be resolved and interpreted exclusively by the Courts of England and Wales.
